About this policy: This Texas Privacy Rights Notice is provided by A+ Hosting Inc., a Nevada corporation, and applies to all services purchased through any of our three brand websites: APlusHosting.com, ServerPoint.com, and ColossusCloud.com. The terms below apply identically regardless of which brand website you signed up through. References to "we", "us", or "our" in this document mean A+ Hosting Inc.
1. Privacy Statement for Texas Residents
This Privacy Notice for Texas Residents supplements the information contained in our Privacy Policy and applies solely to Texas residents. It is designed to comply with the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024.
2. We are committed to privacy
A+ Hosting Inc. is committed to protecting the privacy of personal data we handle. This Notice describes our practices when we act as a "controller" under the TDPSA with respect to personal data we collect from our own customers and website visitors. When we process personal data on behalf of our customers (for example, when customers host their own end users' data on our infrastructure), the customer acts as the controller and this Notice does not apply to that data.
3. TDPSA Overview
The TDPSA provides Texas residents with specific rights regarding their personal data, including the right to know what is collected, the right to delete, the right to correct, the right to data portability, the right to opt out of the sale of personal data and of targeted advertising and profiling, and the right not to be discriminated against for exercising these rights.
4. Information we collect
In the preceding twelve (12) months, we have collected categories of personal data that may include identifiers (such as name, email address, postal address, and IP address), commercial information related to your transactions with us, internet or network activity related to your use of our website, approximate geolocation derived from IP address, and account credentials and payment information.
We obtain personal data directly from you when you create an account, place an order, or contact support; automatically when you use our website; and from third parties that interact with us in connection with the services we provide.
5. Use of personal data
We may use the personal data we collect to fulfil the purpose for which it was provided, to operate and improve our services, to communicate with you about our services, to comply with our legal obligations, to detect and prevent fraud and security incidents, and to protect the rights and safety of our customers and others.
6. Sharing personal data
We may disclose your personal data to service providers and business partners who help us operate our services, to legal and regulatory authorities where required by law, and in connection with a merger, acquisition, or sale of assets.
Where our sharing of personal data qualifies as a "sale" under the TDPSA, you have the right to opt out as described in Section 7.
7. Your rights and choices
As a Texas resident, you have the right to request that we confirm whether we are processing your personal data and access that data, the right to request that we correct inaccurate personal data, the right to request that we delete personal data we have collected, the right to data portability, and the right to opt out of the sale of personal data and of targeted advertising and profiling. To exercise these rights, please submit a request through your Client Portal or our Contact Us page. We will take reasonable steps to verify your identity before responding.
8. Non-discrimination
We will not discriminate against you for exercising any of your rights under the TDPSA.
